The medical record is a legal document and the patient is its sole owner. Clínica CES has implemented a procedure for providing copies of medical records and other care documents, in accordance with legal requirements.
According to Law 23 of 1981 (Art. 34) – Resolution 1995 of 1999 (Art. 1): “The medical record is a private, confidential document that may only be accessed by third parties with the patient’s authorization or in legally established cases.”
According to Ruling T-182/09 by the Constitutional Court: “For deceased patients, or those unable to authorize access due to their mental or physical condition, the medical record may only be accessed by first-degree family members, in compliance with legal requirements.”
